Should I Hire a Fuel-System Designer or a Tank Contractor First?

When to call a fuel-system designer before a tank contractor, what contractors price without a design, and why bids diverge.

Owners ask me this more than any other question, usually after they have already collected two or three contractor bids that do not resemble each other. The honest answer is that it depends on one thing: whether the scope of the project is defined.

If you can hand a contractor a drawing set that says what tank, what piping, what containment, what electrical classification, and what the AHJ has already accepted, a contractor can price it and build it. If you cannot, the contractor has to invent the scope in order to price it. That is where most of the trouble on tank projects starts.

What a contractor prices when there is no design

A contractor bidding without a design is not doing anything wrong. They are doing the only thing they can do, which is make assumptions, attach allowances, and write exclusions. It helps to know what those look like.

  • Assumptions. The bid assumes a tank size and product, a piping route, a dispenser or generator connection point, and a set of existing conditions that nobody has verified. Each assumption is a place where the price can move.
  • Allowances. Electrical, concrete, and site work are often carried as allowances because the contractor does not know what the electrical classification will require, how much slab has to come out, or where the utilities are.
  • Exclusions. Permit fees, engineering, AHJ-required corrections, testing, closure of the old system, and "unforeseen conditions" are commonly excluded. These are the items that become change orders later.

None of this is hidden. It is written into the bid. The problem is that an owner reading three bids sees three prices and assumes they are for the same thing. They are not. One contractor assumed a UL 142 double-wall tank. Another assumed a UL 2085 protected tank because that is what the fire marshal asked for on their last job. A third carried the electrical as an allowance while the first two priced it. The spread between the bids is not a measure of who is expensive. It is a measure of how undefined the scope is.

Why the bids diverge

Fuel systems sit at the intersection of several codes and several AHJs, and the contractors are each reading that landscape through their own recent experience.

  • The fire code (NFPA 30 and NFPA 30A as adopted locally) drives tank listing, separation distances, and dispensing requirements.
  • The county health department on Long Island or in Westchester (SCDHS Article 12, Nassau Article XV, Westchester Article XXV) drives containment, leak detection, and construction and operating permits.
  • NYSDEC Part 613 drives PBS registration and equipment standards in New York.
  • In Virginia, DEQ regulations and the Statewide Fire Prevention Code do the same job with different thresholds.

A contractor who mostly works in one county prices what that county wants. When the project is somewhere else, or when an unusual condition applies, the assumptions drift. Nobody is at fault. The scope simply was not defined before the bids were requested.

The sequence that avoids this

For an owner planning a new system, a replacement, or a capacity expansion, the sequence I recommend is straightforward.

Design First. Investigate the site and the existing conditions. Confirm the product, capacity, and operational needs. Identify every AHJ that has jurisdiction and what each one will require. Select the tank, piping, containment, overfill prevention, and monitoring equipment on paper.

Establish a Defined Scope. Turn the design into a drawing set and a narrative that a contractor can price line by line. The scope names the equipment, shows the routing, and states what is included.

Permit. Submit to the AHJs before construction pricing is finalized. AHJ comments get resolved in the design, not in the field. The contractor is then bidding a system the AHJ has already reviewed.

Obtain Comparable Contractor Pricing. With a permitted design, every contractor is pricing substantially the same system. Bids converge. The spread that remains reflects the contractors' real cost and margin, which is the information you actually want.

Build. The contractor builds to the drawings. Field questions still happen, but they are questions about a defined system rather than a redesign under time pressure.

When the contractor should be your first call

I want to be fair to contractors here, because petroleum contractors are partners on nearly every project I touch and a large share of my work comes through them.

If the project is a straightforward like-for-like swap, a good contractor may be exactly the right first call. Replacing a small diesel day tank with the same size and listing, in the same location, with the same piping, at a site where the existing installation was permitted and is not out of compliance, does not need a separate design phase. An experienced contractor knows what the AHJ expects, will pull the permit, and will do the job.

The same is true when the contractor already has a working relationship with the local AHJ and the scope really is that simple. Many contractors also bring a designer in themselves when the scope grows. That is a normal and healthy arrangement.

Where the contractor-first path breaks down is when the project is not actually like-for-like, even if it looks that way at first. The following are signs that the scope needs to be defined before pricing.

  • The existing system was never permitted, or the permit does not match what is installed.
  • You are changing product, capacity, or tank location.
  • You are converting from underground to aboveground storage.
  • More than one AHJ will review the project.
  • The site has electrical, structural, or containment conditions that nobody has looked at closely.
  • The bids you already have do not agree with each other on what is being built.

A practical way to decide

Ask yourself whether you could write one page that says exactly what is being installed, where, and to what standard, and whether every AHJ involved would accept it. If yes, call a contractor. If you cannot write that page, or you are not sure who the AHJs are, the project needs a design first. The design is what turns your project from a set of assumptions into a scope that can be permitted, priced, and built with confidence.
