
Fuel tank permits: who issues them and what they require
A fuel tank permit is not one permit. Depending on where the tank sits, an aboveground or underground fuel tank can need a county health department permit to construct, a state registration, a local building permit, a fire marshal approval and, in New York City, Department of Buildings and FDNY approvals. Each one asks for a different piece of the same design. Most delays come from filing with one authority before the others have been identified, or from filing before the design is complete enough to review.

Who issues fuel tank permits
The authority depends on the location, the tank type, the product and the capacity. In most cases more than one agency has a say, and their reviews run in parallel or in sequence. The list below covers the markets where ZE does most of its work.
- Suffolk County, NY: Suffolk County Department of Health Services (SCDHS), Office of Pollution Control, under Article 12 of the Suffolk County Sanitary Code. Permit to Construct, then Permit to Operate.
- Nassau County, NY: Nassau County Department of Health (NCDH) under Article XV of the Nassau County Public Health Ordinance, the county's petroleum bulk storage program, with the Nassau County Fire Marshal enforcing the separate fire prevention ordinance.
- Westchester County, NY: Westchester County Department of Health (WCDOH) under Article XXV (Petroleum Bulk Storage), including registration and a work permit.
- New York State: NYSDEC Petroleum Bulk Storage (PBS) registration under 6 NYCRR Part 613. This is a registration of the facility, not a construction permit, and it is separate from any county permit.
- New York City: depending on the facility, the fuel, the storage configuration and the scope of work, a fuel-system project may require coordination with FDNY, the NYC Department of Buildings and other agencies. The agency path is not the same for every project.
- Everywhere: the local building department for the building permit and the local fire marshal or fire official for fire code review under the state fire code (Chapter 57 for flammable and combustible liquids, Chapter 23 for motor fuel dispensing).
- Virginia: Virginia DEQ registration for regulated USTs (9VAC25-580) and ASTs above the applicability thresholds in 9VAC25-91, plus a local building permit and the fire official's construction and operational permits under the Virginia Statewide Fire Prevention Code.
AST permits and UST permits
Aboveground and underground tanks are reviewed against different standards, and the application packages look different.
An AST application is largely a fire code and containment review. The reviewer wants to see tank listing (UL 142 or UL 2085), setbacks from property lines, buildings, dispensers and public ways, secondary containment, overfill prevention, venting, vehicle impact protection and, on Long Island, the county's own containment and alarm requirements. NFPA 30 and NFPA 30A drive most of the fire code questions.
A UST application is an environmental protection review. Double-wall tank and piping, interstitial monitoring, spill buckets, overfill prevention, corrosion protection, sumps, leak detection and tank gauging all have to be shown. The federal rule at 40 CFR 280, NYSDEC Part 613 or Virginia 9VAC25-580, and any county program apply on top of the fire code.
Modifications count too. Replacing a sump, changing product, adding a dispenser, relocating an AST or changing the fill arrangement can each require a permit, and in Suffolk County a repair or alteration to an abandoned facility requires a Permit to Construct before the work starts.

What a permit application typically needs
The exact packet varies by AHJ, but the content is consistent. If any of these items is missing or inconsistent, the reviewer sends the package back and the clock restarts.
- Site plan showing the tank location, setbacks, dispensers, fill point, vents, drainage and adjacent structures
- Tank and piping design: capacity, product, construction, listing, piping routing, containment sumps and transitions
- Equipment cut sheets for the tank, overfill prevention valve, spill bucket, vents, dispensers, submersible pumps, leak detection and ATG
- Containment and overfill details: dike or double-wall containment, alarm locations, fill arrangement and how the fill operator sees the overflow point
- Fire code compliance: setbacks, vehicle impact protection, emergency shutoff, signage, electrical classification
- Registration forms and fees: county registration where required and NYSDEC or DEQ registration or notification
- Sealed drawings where the AHJ requires them. SCDHS requires drawings prepared, sealed and signed by a professional engineer or architect licensed in New York. ZE coordinates that review through established professional relationships with appropriately licensed Professional Engineers.
- In some counties, a permit to construct is issued first and a permit to operate is issued after satisfactory final inspection
Why the design has to come first
A permit reviewer approves a specific system: this tank, in this location, with this containment, this overfill protection, this piping and this equipment. If those decisions are left for the field, there is nothing to review, and anything that changes after approval can require a resubmittal.
Design first also protects the owner on cost. When the tank, equipment and configuration are defined before bids go out, every contractor is pricing substantially the same system. When they are not, the low bid is often the one that assumed the least, and the difference shows up later as change orders.
ZE's sequence for an owner planning construction is: design first, establish a defined scope, permit, obtain comparable contractor pricing, then build. Permitting is the third step, not the first.

Long Island: how SCDHS permitting works
Suffolk County maintains an extensive local regulatory program for petroleum and hazardous-material storage facilities, reflecting the importance of protecting the groundwater aquifer system that serves as the County's sole source of drinking water. SCDHS administers Article 12 through its Office of Pollution Control and also runs the state PBS program in the county under NYSDEC delegation.
The county issues two permits. The Permit to Construct (application form HMM-001) works like a building permit for the tank system. The packet is the application, a full drawing set, the registration form and the fee. Drawings must be prepared, sealed and signed by a professional engineer or architect licensed in New York. The county reviews the package against Article 12 and Article 7 (groundwater management zones and water supply sensitive areas), then issues an approval or rejection letter to the owner or the consulting engineer. A rejection can be revised and resubmitted.
A Permit to Construct is valid for one year and can be renewed. During construction the county performs periodic inspections. After a satisfactory final inspection, SCDHS issues the Permit to Operate, which carries an annual renewal fee based on the total storage volume at the site and must be posted at the facility. Using, maintaining or filling a storage facility without registering the tanks and holding a valid Permit to Operate is a violation of the code.
Registration reaches nearly all petroleum storage in the county, including fuel oil, gasoline, kerosene, diesel, waste oil and lubricating oil tanks. The main exception is small heating or standby-power tanks under 1,100 gallons outside an Article 7 zone. Inside a groundwater management zone or water supply sensitive area, those exemptions fall away. Nassau County runs a parallel petroleum bulk storage program under Article XV of the Nassau County Public Health Ordinance, with a storage permit and a separate installation permit.

Virginia: DEQ registration plus local permits
Virginia splits the job between the state environmental program and local officials. Virginia DEQ regulates USTs under 9VAC25-580 and larger ASTs under 9VAC25-91. Regulated USTs are registered with DEQ, and the UST rules track the federal program at 40 CFR 280 with Virginia additions. AST facilities above the regulation's capacity thresholds register with DEQ and meet its technical and pollution prevention requirements.
DEQ registration is not a construction permit. The permit to build comes from the locality: a building permit from the county or city building department and a construction permit and operational permit from the fire official under the Virginia Statewide Fire Prevention Code, which adopts Chapter 57 for flammable and combustible liquids. Some localities, Fairfax County for example, publish a specific fuel storage tank review path through their plan review office.
The Virginia Petroleum Storage Tank Fund is a separate program that can satisfy UST financial responsibility and reimburse eligible cleanup costs. It does not replace any permit.

How ZE handles a fuel tank permit
Permit due diligence is the first task on every ZE project: identify every AHJ that will review the work, confirm what each one requires, and find the constraints before the design is drawn. The design is then developed to those requirements, the applications are prepared from the design, and ZE carries the submittals through review comments, revisions and approval. Reviewed and sealed by an appropriately licensed design professional when required by the applicable AHJ. ZE coordinates that review.
During construction ZE supports the owner and contractor through inspections and closeout so the permit to operate, certificate of occupancy or final sign-off is not held up by a missing document.

Common questions
Do I need a permit to install an aboveground fuel tank?
In almost every commercial setting, yes. At minimum the local fire official reviews an AST under the fire code, and most localities require a building permit. In Suffolk County an AST needs an SCDHS Permit to Construct and registration unless it falls under a narrow heating or standby-power exemption, and that exemption disappears inside an Article 7 groundwater zone. Nassau and Westchester run their own permit programs. In Virginia the locality issues the building and fire permits, and DEQ registration applies above the 9VAC25-91 thresholds. Small residential heating-oil tanks are the most common exception, and even those have overfill and fill requirements in many jurisdictions.
How long does a fuel tank permit take?
It depends on the AHJ, the completeness of the application and how many agencies have to sign off. A complete package with a clear design moves in weeks. A package that gets returned for missing information, or one that has to go through a county health department, a fire marshal and a building department in sequence, can take months. The single biggest thing an owner controls is submitting a complete design the first time. ZE will give you a realistic schedule for your specific jurisdiction once the AHJs are identified.
Can my contractor pull the permit?
Usually the contractor can file the building permit, and in many jurisdictions the contractor or the owner's agent submits the tank permit application. What the AHJ actually reviews is the design behind the application: the drawings, the equipment, the containment and the code compliance. Where a sealed drawing set is required, as it is for an SCDHS Permit to Construct, the drawings have to be sealed by a professional engineer or architect licensed in the state. ZE prepares the design, coordinates the PE certification where required, and works alongside the contractor on the submittal. Contractors are partners on ZE projects, part of the project team.
Is NYSDEC PBS registration the same as a tank permit?
No. PBS registration under 6 NYCRR Part 613 records the facility and its tanks with the state and has to be kept current when tanks are added, removed or modified. It is not an approval to build. In Suffolk, Nassau and Westchester the county issues the permit and also administers the state program locally, so both a registration and a permit apply.
What happens if I install a tank without a permit?
The tank is unpermitted and, depending on the jurisdiction, the facility may be operating illegally until it is legalized. In Suffolk County it is unlawful to use, maintain or fill a storage facility without registering the tanks and holding a valid Permit to Operate. The path back is a legalization application: document the installation, evaluate it against current code, design any corrections, permit and inspect.
